WATCH: Men, the Game is Over. You Better Watch Yourselves: 65-Year-Old Man Faces 1 Year in Jail for Slapping Denny’s Waitress On the Behind While Wife Was in the Bathroom

ROME, NY – A 65-year-old man has been charged Monday with forcible touching after Rome police say he slapped a Denny’s waitress on the butt as she walked away from his table.

Police say Clarence H. Locke Jr. smacked the waitress as she walked away from the table where he was sitting about noon Monday at the Denny’s Restaurant on James Street in Rome.

The waitress reported it to her manager, who told the man to leave, police said.

Rome police identified the man after watching a surveillance tape that captured the slapping. Police arrested Locke about 1:30 p.m. Monday.

Forcible touching is a Class A misdemeanor, punishable with up to a year in jail or three years probation.

Locke was released on an appearance ticket for City Court.
