Judge Denies Josh Duggar’s Motion to Dismiss Danica Dillon’s Lawsuit

It’s more bad news for Josh Duggar.

On Wednesday, a judge denied the former reality star’s motion to dismiss a lawsuit filed against him for battery by adult film star, Danica Dillon, whose real name is Ashley Stamm-Northup. “We decline to grant Duggar’s motion to dismiss at this early stage of litigation where Stamm-Northup alleges Duggar treated her roughly, caused physical injuries, and she felt ‘as if she was being raped,'” Pennsylvania judge, J. Kearney, determined.

The 27-year-old will have to respond to Dillon’s allegations by Jan. 20.

Duggar’s motion was filed on Dec. 30 and argued that Dillon “did not provide anything more than a formulaic recitation of the elements of assault and/or battery.”

“Her labels and conclusions are not adequate, particularly because she states that she consented to physical and sexual contact in exchange for payment,” Josh’s lawyer, Jeffrey A. Conrad, argued in the court documents.

In his motion, the former 19 Kids and Counting star stated that he did in fact have sex with Dillon for money on two occasions. She is now asking for $500,000, alleging that he caused her “physical and emotional injuries” during these meet-ups.
