
San Francisco 49ers linebacker Ahmad Brooks and former Niners defensive end Ray McDonald will face charges stemming from an incident last December in which a woman claims she was raped by McDonald.
A grand jury in Santa Clara County, Calif. on Wednesday indicted McDonald on one charge of raping an intoxicated person.
Prosecutors on the same day charged Brooks with misdemeanor sexual battery. The woman filed a civil lawsuit against Brooks earlier this year claiming that he touched her in a sexual manner on the same night she says she was assaulted by McDonald.
“The organization is aware that a misdemeanor charge has been filed against Ahmad Brooks stemming from a December 2014 matter,” 49ers general manger Trent Baalke said in a statement. “We take any charge against a member of this organization seriously and are in communication with the NFL. Ahmad is returning home to California and will not participate in Saturday’s game.”
Brooks had been with his teammates in Englewood, Colo. for joint practices with the Denver Broncos.
The woman told police she met McDonald at a bar in San Jose and went back to his home to continue partying. There, she recalled falling by a hot tub and hitting her head, but remembered nothing else until she woke up the next day in McDonald’s bed. McDonald told police he had consensual sex with the woman.
